Right of revocation

RIGHT OF REVOCATION

The purpose of ELIOS ("the Seller") is to ensure your complete satisfaction. If for any reason you are not satisfied with your order, you may exercise your right of withdrawal, without penalty, within 14 days from the day you received the products purchased on www.eliosmilano.com. The products to be returned must be handed over to the carrier within fourteen (14) days from the date you informed the Seller of your decision to withdraw from the contract.



The products may be returned by sending the package via the courier indicated by the Seller (Poste Delivery - Poste Italiane), or via another courier. Before sending the products back by courier, you must fill in the Return and Exchange Form [DOWNLOAD HERE] (conforming to the standard form pursuant to Article 49, paragraph 4 of the Consumer Code) or draft and send to the Seller another explicit declaration of your decision to withdraw from the contract, it being understood that in the latter case, the burden of proving the correct and timely exercise of the right of withdrawal shall remain with you.



1. Conditions for exercising the right of revocation


The right of withdrawal shall be deemed to have been properly exercised if the following conditions are fully complied with

a) the Return and Exchange Form [DOWNLOAD HERE] transmitted directly online through www.eliosmilano.com or any other explicit declaration of your decision to withdraw from the contract must be correctly completed and transmitted to the Seller within fourteen (14) days of receipt of the products;

b) the products must not have been used, worn, washed and must necessarily comply with the requirements described in the Conformity Checks section below;

c) the identification tag must still be attached to the products with the disposable seal constituting an integral part of the goods;

d) the products must be returned in their original packaging;

e) the returned products must be handed over to the forwarding agent within fourteen (14) days starting from when you have informed the Seller of your decision to withdraw from the contract

f) the products to be returned must be sent to the Vendor in their original packaging and with the corresponding pre-printed return label

g) the products must not be damaged.



If you have complied with all the required conditions, the Seller will refund the price of the purchased products in full, and you will be responsible only for the return costs, i.e. the costs of returning the purchased products to the Seller, unless the Seller has expressly exempted you from these costs at the time of purchase and on the further condition that you use the forwarding agent indicated in the Return Form. Should you decide to use the courier chosen by ELIOS MILANO for the shipment of the products purchased (Poste Delivery - Poste Italiane), you will not be required to pay the return shipping costs. ELIOS MILANO will pay the courier Poste Delivery - Poste Italiane on your behalf, deducting from your refund an amount equal to the cost previously incurred for the delivery of the products purchased to your home. If, on the other hand, you decide to use a different courier, you will have to pay the return shipping costs yourself.

You will be contacted if your return cannot be accepted because it does not comply with the conditions indicated in letters a) and e) of the previous paragraph. In this case, you may choose to have the purchased products back at your expense. Should you refuse this shipment, ELIOS MILANO reserves the right to retain the products and the amount corresponding to the purchase price of the products. You will also be contacted if your return cannot be accepted because it does not comply with the conditions set out in the previous paragraph. In this case, you will be able to choose whether to accept the reduction in the refund, which will be communicated to you, due to the diminished value of the returned products, or to have the products purchased back at your expense.



2. Conformity checks


Our products must be returned unused and new, in perfect condition and complete with all protective materials, with any labels and tags attached and including all accessories and documents. If the product shows signs of wear and tear or has been used or altered in any way from its original condition, we reserve the right not to accept the return or, alternatively, to reduce the amount of the refund or exchange.



For example, we may reduce the refund in the following circumstances



the product(s) have been used, worn, damaged or washed;

the identification tag with the disposable seal is not attached to the product(s) or has not been returned. Please note that the identification tag is an integral part of each product; and/or

you have not returned the packaging that is an integral part of the product (e.g. the bag).

If it is necessary to reduce your refund for any of these reasons, we will inform you. In this case, you may (as an alternative to a reduced refund) choose to have the products sent back to you at your expense. If you refuse this option, ELIOS MILANO reserves the right to retain the products and the amount indicated for the reduced refund due to the reduced value of the returned products.



3. Refund times and methods


After the Seller has received your return and checked that all requirements have been met, you will receive an e-mail confirming acceptance of the return and the refund procedure indicated herein will be activated. The goods will become the property of ELIOS MILANO once again. In the event that the value of the returned products is found to have decreased, you will receive an e-mail informing you of the amount deducted from the refund. Whatever method of payment you used (credit/debit card, PayPal), the refund shall be activated by the Seller as soon as possible, and in any case within fourteen (30) days from the date on which it became aware of the exercise of your right of withdrawal, once it has verified that the withdrawal was made in compliance with the above conditions.



The actual time for the re-crediting or refund of the sums paid by you for the purchase of the products depends on the method of payment used:



purchase by credit/debit card: the refund time depends on the credit/debit card company, but normally takes place within two statements. Please note that the value date of the refund is the same as that of the debit, so you will not suffer any loss in terms of bank interest.

Purchase via PayPal: the refund will be made to your PayPal account and will be visible immediately. The actual refund to your credit card from your PayPal account depends on the institution that issued the card.

4. Conditions for product exchange
In some specific cases, duly indicated in the Return and Exchange Form, you will have the possibility to replace the purchased products with others, instead of obtaining a refund of the relative price.

The replacement request will be made within the limits set out below:

a) only those products purchased for which this possibility is expressly provided for in the Return and Exchange Form by means of the wording "Exchange" may be replaced

b) you may only request the replacement of one or more products purchased with products of the same model, having a different size and/or colour. In any case, the options available for replacement will be indicated in the Return and Exchange Form;

c) the possibility of replacing an item is subject to the availability of the size and/or colour of the model in question;

d) you may request the replacement of one or more purchased products within and no later than fourteen (14) days from the date of their delivery, by filling in the Return and Exchange Form, to be sent electronically to the Seller within the aforesaid deadline. The products to be exchanged must be delivered to the carrier within fourteen (14) days from the date of completion of the Return and Exchange Form;

e) You may only make one exchange request per product purchased;

f) the products for which you request an exchange must be returned to the Vendor in their original packaging, unused, unworn, washed or damaged, and the identification tag must still be attached with the disposable seal

g) the products to be replaced must be sent to the Vendor in their original packaging and with the corresponding pre-printed return label.



If all the above conditions are correctly fulfilled, once the Return and Exchange Form containing your replacement request has been completed and sent, the Vendor will take charge of the replacement request by sending you a confirmation email to that effect.



5. Time and modalities for obtaining the replacement
After the Vendor has received the products you wish to exchange and checked that all the requirements set out above have been met, it will check the actual availability in its warehouses of the products in the size and/or colour you have selected.



In the event that the product or products selected for replacement are not available at the Seller's warehouses, the Seller will not be able to accept your request for replacement and will therefore proceed to refund the price of the product or products originally purchased and not replaceable, in accordance with the procedures set out in the sections of this policy.



In the event that the product or products selected for replacement are available, the Seller may accept your request for replacement and will therefore send you an email confirming that the replacement products have been shipped. Shipment will take place within thirty (30) days from the date on which ELIOS MILANO becomes aware of your replacement request, once it has verified that the replacement has been made in accordance with the above conditions.



The costs of shipping the replacement products shall be borne by the Seller, which shall choose the relevant carrier. Where the price of the product purchased is lower or higher than the price of the product selected for replacement, you will not be entitled to any refund and/or surcharge for the difference. You will be contacted if your replacement request cannot be accepted because it does not comply with the above conditions.



In this case, you may choose to have the products you wish to replace returned to you at your own expense. Should you refuse this shipment, the Vendor reserves the right to retain the products and the corresponding amount for the purchase of the same. The replaced product(s) may be returned at a later date pursuant to and within the limits set out in the preceding Sections.



6. Product identification tag


All products offered for sale by the Vendor have a tag, which is an integral part of the product. We invite you to try on the product without removing the tag because returned products without one will not be accepted.



7. Poste Delivery - Poste Italiane


Returns can be sent via the Poste Delivery - Poste Italiane courier indicated by the Seller, using the label that will be sent to you by email. This method will allow the Seller to pay for the shipment on your behalf and to check where your package is at any time.



If you decide to use a shipping agent other than the one indicated by the Seller to return the products, you will have to pay the return shipping costs yourself and you will be responsible for any loss or damage to the products during transport.
